The company said in a statement that its decision to depart the Australian market was in response to "a shift in focus towards other markets where the company now sees a higher potential for growth".

"There is a real fear these cases will be successful against Foodora but Foodora won't have the money in the Australian company to pay redundancies", he told AAP on Friday.

Food delivery service Foodora will stop operating in Australia this month after three years bringing meals to the nation's doorsteps.

Foodora is also being sued by Fair Work Ombudsman for allegedly treating three of their delivery drivers as independent contractors instead of actual employees of the company.

The company said it will work to ensure its 41 employees find suitable alternative roles, and expressed its support for partners and contractors during the transition period. After that and until August 20, there will be a wind down of services with fewer shifts available.

Another rider appealed to the Fair Work Commission saying he was unfairly dismissed after speaking out over low pay and poor conditions. As well as its on-staff employees, the company has 1000 independent contracts and more than 2500 restaurants on its books.

"Foodora would rather pull out of Australia and leave thousands of riders without work rather than pay them the millions of dollars they owe". On 26 July, Justice Perram ordered foodora to file and serve its defence by 31 July, and the next step is a case management hearing scheduled for 4 September.

TWU National Secretary Tony Sheldon said Foodora, like other food companies, had denied riders fair rates, superannuation, workers compensation and annual leave. "Foodora was always proud and boasting about how fast it was growing", he said. No further official statement is available.

In light of these issues, Foodora spokesperson told the ABC that "Foodora will continue to manage legal proceedings locally in Australia and will continue to treat them with the utmost importance".
