"By murdering his grandfather, Nathan deprived John of the enjoyment of his last years, the fruits of his industry, and his family", attorneys for Nathan Carman's aunts wrote.

On Wednesday, Carman's attorney filed a response.

A Vermont man denies allegations he murdered his grandfather, arguing the 87-year-old didn't live in New Hampshire at the time of his death, according to court documents.

The petition alleges that Carman committed the "heinous act" of shooting and killing Chakalos in his Windsor home out of "malice and greed" and states "the petitioners believe that Nathan murdered their father, and they ask this court to so find". Police have acknowledged that Carman is a suspect in that case, but no one has been charged.

Their lawsuit filed in July says Carman argued with his grandfather about money prior to his death, and that Carman purchased a semi-automatic rifle of the same caliber used to shoot his grandfather.

The two had been on a fishing trip when their boat sank. It also raises questions about whether the boat sank in the spot where Nathan Carman claims, alleging that the life raft "could not have drifted from Block Canyon to the position where Nathan was rescued".

Nathan Carman told investigators that the boat took on water quickly so he ran and grabbed the emergency kit before it sank and got on the life raft. He also denied deploying the life raft that only he ended up on, but admits that "at some point his provisions made it to the life raft".

The suit also claims, "Prior to leaving shore, Nathan removed the trim tabs from the boat, which left patched holes that made the boat more unsafe and easier to sink".

The case was filed in New Hampshire where the grandfather owned a home but Carman's lawyers argue he wasn't a resident so the case is out of their jurisdiction.

A lawyer for Nathan Carman's aunts say New Hampshire is the appropriate venue for the lawsuit. "He loved the home that he and his wife Rita had built and which they shared with the surrounding community every Christmas". Throughout his life, John remained an active contributor to the St. George Greek Orthodox Church where he was raised.

"The groundless claims and denials contained in Nathan Carman's response filing do not reflect reality, and we are confident the legal process will recognize this", Small said.
